1. Agreement to Terms

By using the Patofy platform and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, then you may not access the Service.

2. Our Services

Patofy provides a subscription-based software-as-a-service platform that uses artificial intelligence to automate client communications and marketing workflows. Our service includes a "Done-With-You" onboarding process to configure the platform for your specific business needs.

3. Subscriptions and Payment

Our Service is billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring monthly or annual basis.

• Billing Cycle: Subscriptions are automatically renewed at the end of each billing cycle unless you cancel.
• Payment Method: A valid payment method is required to process the payment for your Subscription. You shall provide accurate and complete billing information.
• Activation Fee: Certain plans may require a one-time, non-refundable "Success & Activation Fee" to cover the cost of our white-glove onboarding service.
• Usage-Based Billing: Your plan includes a specific number of "Engaged Contacts". If your usage exceeds this limit, you will be billed for the overage at the rate specified for your plan.

4. User Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account and password.
• All activities that occur under your account.
• Ensuring that the data you provide for us to process (e.g., in your Google Sheet) is accurate and that you have the legal right to use it for marketing purposes.
• Complying with all applicable laws and regulations, including those related to privacy and electronic communications, in your jurisdiction.

5. Prohibited Uses

You may not use the Service for any illegal or unauthorized purpose. You agree not to send spam, unsolicited messages, or any content that is unlawful, harmful, or otherwise objectionable. We reserve the right to suspend or terminate your account for any violation of these terms.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of AcidCat Digital and its licensors.

7. Limitation of Liability

In no event shall AcidCat Digital, nor its directors, employees, partners, or agents, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

8. Termination

You may cancel your subscription at any time. We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice prior to any new terms taking effect.
